i am finding the tail never wants to sit stright . i am allways counteracting the move.as soon as you hover the tail wonders. i have set the gyro gain at 3/4 .. but it is not very nice to fly .. :(

You should be able to turn the gyro to NON head holding mode and the helicopter should hold a hover. If you cant do this you need to center the tail (adjust servo mount or pushrod) Once it hovers with no tail input in this mode THEN flip it to HH mode.

You can also put in some rudder subtrim until it holds well. The align gyro, E-Flite gyro and Telebee gyro are all pretty much the same gyro. They all need rudder subtrim to stay still.

Well if you cant turn HH on and off I am not sure what to tell you. (Moving to Futaba section)

Frog: You can center ANY helicopter without sub trim which is why the tail push rod has threaded ends. Subtrim is the lazy way and you are not going with the servos "natural" center. ;)

As Dog suggested. If you can disable HH mode , put it in Rate mode. Should be able to do that with the Channel 5 ATVS. The switch controlling (GEAR) channel 5, I would think flipping it the other way would put the gyro in HH or Rate mode.
Once in Rate mode ( non HH). Zero all the trims, make sure they are neutral, make sure there is no rudder mixing activated in the radio. Then hover the heli and mechanically adjust the tail push rod till the heli will hover straight. I would start with about 60% ATV on channel 5 for a gain setting. Once you have done this you should be able to flip in HH mode and it will be fine. Try 60% gain on HH mode also. You should see the numbers change on Channel 5 ATV as you flip the gear switch on the TX back and forth. One side will be HH mode, the other should be Rate mode.
