You might want to look at http://www.aplanding.com - look in the "Documents" forum and read the letter from the aviation lawyer in there. It's really interesting.
I did some research of my own and it looks like the FAA has authority over "navigable airspace".. Navigable airspace is generally defined as 700' AGL and up (with some excetions, i.e. airports)..
