Could be one of the following:
1. The tail pin for the rotor is too tight. a good test is to blow on the tail rotor... it should spin really easy. I've sometimes gotten hair or carpet threads twisted around causing it to bind. Inspect carefully and ensure that there is sufficient "play" and that the tail rotor spins freely.

2. Your tail motor is going... they don't last forever... it is possible that you need a replacement motor.

3. Your gyro is messed up... hope this isn't the case as a new receiver unit is expensive!

It's actually a week old with 40 packs though it I suspect it's Motor going out the mesh on the tail is fine no debris and it free spins it's acting like a larger heli when the tail hunts

Is your heli BL? If so it's sensitive to any minor tail movement. Have you crashed at all? Is there any small tail boom movement?
Hope this helps!
P.S.
Also check the flybar is not bent.

It's a brushed version heli-max doesn't offer a bl yet and didn't know it was a 4#3b before I bought it. All the reading leads me to belive it's a strong chance it's a motor that's going out since I'm averaging 5 packs a day

40 to 50 flights is a bit on the low side for the life of a brushed tail motor, but not totally out of reason... If you follow the progression of my posting above (#2), buy a new tail motor for a few bucks and see if that solves your problem.

I have noticed with mine that sometimes a flybar paddle is a little off and causes the tail to act up also.

Just remembered that I also had a tail rotor bearing go bad which caused bobbing and also wore out the tail rotor shaft on my FP.

Check your tail rotor shaft for play.

Since my frame was the victim of the anti rotation bracket snapping when the frame was changed out I noticed only 1 wire on the tail motor had heatshrink and a good solder conection the black wire had a dab of cold solder and no heat shrink corrected that issue and problem solved.

Cool.

I broke my AR bracket but hot glued it back with some blobs of glue.

Then I found in the tips thread that it is a good idea to add some similar blobs to a new frame to greatly reduce the chance of the new one breaking in the first place.

That seems a good tip.
