FAA Registration Regulation struck down

The US Court of Appeals for the District of Columbia has struck down the FAA's registration regulation!

In a stunning David versus Goliath case, John A. Taylor, a model aircraft enthusiast and insurance lawyer, beat the Federal Aviation Administration and Department of Justice in a case challenging the legality of a December 2015 FAA rule requiring model aircraft to register like manned aircraft. The Court of Appeals for the District of Columbia ruled that the FAA's registration rule, as it applies to model aircraft, "directly violates [a] clear statutory prohibition."

The statute that the Court refers to, and that Mr. Taylor relied on in his challenge, is Section 336 of the FAA Modernization and Reform Act of 2012. That statute prohibited the FAA "from promulgating any rule or regulation regarding model aircraft." The Court found that Congress had "weighed in" on the issue of the regulation of model aircraft and the law codified "the FAA's longstanding hands-off approach to the regulation of model aircraft." The statute defines model aircraft as an unmanned aircraft that is capable of sustained flight in the atmosphere, flown within visual line of sight and flown for hobby or recreational purposes.

Sweet maybe I'll pick up flying again. I never registered but I also haven't flown since. My guess is the FAA will challenge this ruling. Will need to wait and see what happens. Local municipalities have their own set of rules about where you can and can't fly. It's creating a patch work of laws that no one really knows who actually has authority.

Line of sight I absolutely believe should be free like what was intended. FPV I think should require some sort of license JMO.

Maybe he should be hired to lead the inadequate AMA. AMA should have done this themselves instead of promoting registration.

AMA never would get behind this lawsuit. That was a shame that they didn't. I would imagine they thought that alienating the FAA with their support was not a good idea.

They were a wet noodle! What's the point of having an advocacy group that just backs down? Seems like a waste of money to me.

Have to give them credit though for rule 336. Hopefully they grow a pair now and actually start fighting for our interests. If not hopefully someone steps up and creates a group that fights for the modelers rights. It's going to be challenging times ahead. Commercial drones will be fighting for the same airspace. We need an advocacy group that has a back bone.

Maybe the drone folks can start an advocacy group I'd probably contribute to that. AMA is typically staunchy old men. They probably aren't inline with the new tech and the young folks who gravitate towards it.
