Default Is it legal to download Phoenix?

I may sound dumb but, is it legal to download it? From what I read it's not being sold anymore but still has copyright. Can anyone help me with this?

The download itself is only the first of the legalities.

Since the software itself is locked to the USB dongle, you’d need to bypass that to use it…. (definitely illegally)

But is it illegal? This site discussed the legality of 'Abandonware': https://bit-tech.net/reviews/gaming/...-essentials/1/

In reality it a moot point. Technically legal or not, no-one is going to 'come after you' if you do use it because the business behind Phoenix doesnt exist anymore. Ethically you aren't depriving any business or person of profit, so your conscience can also be quite clear.

Downloading it has always been free and clear. Using it without an approved dongle is where it might get grey since the product is no longer being sold.

If you search for a Phoenix dongle online you can find one on Amazon or ebay.

Phoenix is still very much worth using.
Especially if you have at least a low end gaming PC with a Graphics card.
Until this year I never had a PC that Phoenix would work at its best. I got started in 2010.

There are over 600 User made planes available for it and quite a few very nice user made flying fields.
I'm a heli guy but love to learn the planes too.

3dxl who is a 3d animater recommends not updating it past 6.0i
He built this Macross VF31A for Phoenix.
Macross Delta VF-31A Kairos build for Phoenix R/C simulator (22 min 27 sec)

As I understand it.... Phoenix was developed and owned by a UK company called Runtime Games Ltd. Horizon did distribution for them but the intellectual rights to the software were owned by Runtime, not Horizon.
Runtime was dissolved in 2019 so Phoenix can be classed as ''abandonware' or 'orphaned' software. Legally it's a grey area because although distribution of the software might still technically be illegal, the owners dont exist anymore, so no one is going to come after you.

if the company does no longer exist the copyright is dead too, nobody could accuse you.

I thought Horizon Hobby had bought Phoenix back then or was just the sole exclusive distributor worldwide...

Phoenix was developed and owned by Runtime. Horizon latterly did the distribution but to the best of my knowledge never owned the rights to the software.

As you say the copyright is effectively dead because the company that owned it no longer exists.
